General Terms and Conditions (GTC) of WAY Transport s.r.o.
 

1. Scope of Application

1.1 These General Terms and Conditions (GTC) apply to all national and international transport services offered by WAY Transport s.r.o., Lidická 700/19, CZ 60200 Brno, Czech Republic, Company ID: 04577612 (hereinafter referred to as the “Company”).

1.2 For national transport services, the respective national freight forwarding conditions apply:

1.3 For international transport, the CMR (Convention on the Contract for the International Carriage of Goods by Road) applies.

2. Conclusion of Contract
 

2.1 Customers can calculate the transport price using our online calculator and book the transport directly. After booking, we will check the feasibility of the transport. We reserve the right to cancel or not confirm bookings at any time. In such cases, the customer will be informed in due time.
 

2.2 Customers may also request a transport quote via inquiry@euro-kurier.com or directly from their contact person at our company.

2.3 The contract is only concluded upon our written confirmation.
 

3. Payment Terms
 

3.1 Before confirming the transport, we carry out a credit check of the customer. If the credit rating is positive, payment on invoice is possible. If the credit check is insufficient, we will issue a pro forma invoice, and the transport will be carried out only after full payment has been received.
 

3.2 Invoice amounts are due for payment within 7 days from the invoice date without any deductions.

4. Packaging and Labelling
 

4.1 The customer is obliged to properly package and label the goods to prevent damage during transport. The company is not liable for damage resulting from inadequate packaging or labelling.
 

4.2 The packaging must comply with legal requirements and be suitable for transport.
 

5. Liability and Insurance
 

5.1 The company’s liability is governed by the provisions of the applicable national freight forwarding conditions.
 

5.2 For international transport, the CMR (Convention on the Contract for the International Carriage of Goods by Road) applies.
 

5.3 The company is only liable for damage caused by gross negligence or intent. The company accepts no liability for loss or damage caused by force majeure.
 

5.4 The customer is obliged to take out transport insurance unless expressly agreed otherwise.
 

5.5 The company is liable to the customer for loss or damage to a consignment only to the extent of the direct, typical contractual damage and within the statutory liability limits.
 

6. Cancellation and Changes
 

6.1 Cancellations and changes to bookings must be made in writing. Cancellation fees may apply depending on the timing of the cancellation.
 

6.2 The customer may cancel the transport contract free of charge up to 24 hours before collection. For cancellations made less than 24 hours in advance, a portion of the agreed price may be charged.
 

7. Collection and Delivery of Shipments
 

7.1 Shipments are collected at the agreed time from the collection address. Only one attempt will be made for both collection and delivery.
 

7.2 Shipments are delivered to the unloading location specified in the transport order and handed over against signature. If the recipient is not present, the shipment may be accepted by another authorised person, such as a neighbour.
 

7.3 Our company is not obliged to return empty pallets or transport boxes unless otherwise agreed.
 

7.4 If the shipment cannot be collected or delivered as planned, it is considered undeliverable. The customer may request additional attempts for a fee.
 

7.5 Shipments with incorrect addresses or those that are refused are also considered undeliverable. Undeliverable shipments will be returned to the customer for a fee.
 

7.6 The total value of the goods contained in the shipment must not exceed €10,000. If the value exceeds €10,000, this must be communicated in advance. Otherwise, we assume the value is below €10,000. Goods exceeding this value will only be transported by special agreement.
 

8. Online Calculator
 

8.1 Our online calculator is designed for standard transport services and not for ADR (dangerous goods) or temperature-controlled transport.
 

8.2 For ADR or temperature-controlled transport, price quotes can be requested via inquiry@euro-kurier.com.

9. Customs Clearance and Client Responsibility

9.1 When transporting goods to or from countries outside the Schengen Area, customs formalities may be required.
 

9.2 We offer the preparation of export and import documents for an additional fee.
 

9.3 All other costs, such as customs duties, taxes, and other charges, are not included in the transport price and are the sole responsibility of the client.
 

9.4 The client is responsible for providing all necessary documents and permits required for smooth customs clearance.
 

9.5 If delays or additional costs arise due to incomplete or incorrect documentation, the client bears full responsibility.
 

9.6 Our company accepts no liability for delays caused by customs procedures or official inspections.
 

10. Data Protection
 

10.1 All personal data of customers is treated confidentially in accordance with applicable data protection laws and used solely for the execution of transport services.
 

10.2 The customer agrees that their data may be stored and processed electronically.
 

11. Electronic Data Exchange
 

11.1 Each party is entitled to create, transmit, and exchange declarations and communications electronically, provided the sending party is identifiable.
 

11.2 The sending party bears the risk for the loss and accuracy of the transmitted data.
 

11.3 Documents created electronically or digitally are equivalent to written documents.
 

12. Confidentiality

12.1 Jede Partei ist verpflichtet, alle nicht öffentlich zugänglichen Daten und Informationen vertraulich zu behandeln und ausschließlich für den vorgesehenen Zweck zu verwenden.

12.2 Daten und Informationen dürfen nur an Dritte weitergeleitet werden, die sie im Zusammenhang mit der Erfüllung des Vertrages benötigen.
 

13. Final Provisions
 

13.1 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
 

13.2 Amendments and additions to these GTC must be made in writing.
 

13.3 The place of jurisdiction for all disputes arising from or in connection with these GTC is the registered office of the company.
